NEW YORK (AP) — The former Marine who fatally strangled a New York homeless man, Jordan Neely, on a subway has been officially identified as Daniel J. Penny. His identity was confirmed by a Marine Corps spokesman.

Penny left the service in June 2021 after serving four years as a sergeant with the 1st Battalion, 2nd Marines, and 2nd Marine Division at North Carolina’s Camp Lejeune. He was a decorated sergeant who received seven medals. Between December 2017 and July 2019, he was deployed to the 22nd Marine Expeditionary Unit located across the Mediterranean, Daily Mail reported.

Daniel J Penny accused of killing Jordan Neely

Penny has yet to respond to Neely’s death, which has now been ruled a “homicide.” The 30-year-old homeless man who was a Michael Jackson impersonator began yelling and littering on the F train Penny was riding. The Navy veteran tried to subdue him after strangling him as the train approached the Broadway-Lafayette station.

Penny allegedly strangled him for almost 15 minutes, according to some of those on board. Footage showed him holding the homeless man on the station floor by his neck. The victim was then taken to a hospital where she was pronounced dead. The New York police questioned the former sergeant and released him Monday. The New York City Office of the Medical Examiner ruled the death a homicide based on the form of visible pressure on the neck.

After Neely’s death was ruled a homicide, protests broke out across the city seeking Penny’s arrest. While many people, including activist groups like the BLM and Democrats like AOC, called the homeless man’s death a “lynching” and a “murder,” others called Penny a hero for his action to protect himself and other passengers from the violent tyrant.

Speaking of Neely’s declining mental health following his mother’s murder in 2007, his aunt said: “My sister Christie was murdered in 2007 and after that she was never the same.
