A woman who killed her grandfather in an accident and then tried to blame it on a group of African men returns to prison with her newborn baby to accompany her. Alisha Fagan was jailed for at least six months on Thursday after killing a beloved father and grandfather in a terrifying accident in Melbourne in June last year. The 22-year-old’s case faced delays in Victoria County Koori Court, while Judge Scott Johns questioned what options were available to give birth in jail or have her child in custody.

Details of her pregnancy were suppressed by the court while her case was heard and Thursday’s sentencing was postponed until after she gave birth in July. Her daughter was in the courtroom when she was sentenced to a total of two and a half years behind bars after she pleaded guilty to driving offenses and bail.

Fagan had four sets of bail for driving offenses when she struck and killed grandfather Sedat Hassan, 69, on June 9, 2022. Johns said Fagan, a suspended learner driver, had a terrible driving record before the fatal crash and a history of driving at outrageous speeds. She had been drinking and was driving 28 km/h over the speed limit on a residential street when she failed to yield at an intersection and crashed into Hassan’s car.

Fagan’s passengers fled, but she waited for emergency services to arrive, then gave police a false name. She claimed that four African men she did not know were in the car with her and that one of them had been her driver. Johns said the depth of Hassan’s family’s grief cannot be described in words. He said Fagan had suffered a lot in the last 14 months, but she had grown up and shown genuine remorse and her circumstances warranted leniency and mercy.

Johns said that Fagan’s lifestyle before the accident was erratic and that she had taught herself to drive because no one else was around. She said she struggled with anxiety and accepted that the 76 days she spent in custody before being released last year were “terrifying and traumatic”. Johns took into account the additional punishment she received through media coverage of her offense and comments from social media users about her actions.

A medical expert said Fagan had a deep desire to be a loving provider for her son and she wanted to keep her baby in custody. The judge accepted that she had been stressed by what would happen to her son and noted that separating children from indigenous parents was a problem and an ongoing trauma. Her application to participate in the Corrections Victoria Living With Mum program, which allowed women to maintain their bond with their children in custody, was approved.

Fagan previously read a letter of apology to Hassan’s family, saying that she took full responsibility for her actions as a severe alcoholic with no impulse control and no understanding of the consequences. “Please know that who I was then and who I am now is not the same person,” she said.
