A 19-year-old woman was arrested in a murder case Tuesday just over a week after her 2-month-old daughter was found dead in an Amarillo, Texas, home. Investigators with the Amarillo Police Department say they were able to determine on February 21, the date of the alleged murder, that Ashley Kay Harper had injured the baby. That night, around 6:25 p.m. At m., officers said, investigators went to the W. Central Avenue residence where the newborn had stopped breathing. It was evident that the baby was already dead.

“A two-month-old female had died at that location when rescuers arrived. As with all child deaths, the Amarillo Police Department Homicide Unit was called to investigate the incident,” the police department said. “During the investigation, evidence was found to place the mother, 19-year-old Ashley Harper, under arrest for injury to a child.”

Although it’s not entirely clear what investigators learned after February 21 about Harper’s alleged actions, a murder warrant was issued seven days later in the case. KVII has since identified the victim as Eva Salene Diaz. The report says investigators believe Harper struck the baby over the head with her hand. The defendant allegedly confessed under questioning.

Ashley Kay Harper accused of killing own baby

Potter County Detention Center records reviewed by Law & Crime show Harper remains being held there on $750,000 bond on the murder charge. After initially stating that Harper was charged, investigators noted that the case is still in a pre-indictment stage and that an order was issued Tuesday to upgrade the felony charge of battery to a child to murder.

Texas law says that the charge of first degree injury to a child applies when an offender “intentionally” or “knowingly” causes serious bodily injury to a victim under the age of 14. While that charge is only punishable by five to 99 years in prison on conviction, the murder charge could make this a capital case. Jail records list Amarillo defense attorney Mike Warner as Harper’s attorney in the case. Law&Crime contacted Warner’s office for comment on the case.

An obituary for baby Eva said that she “was born at 5:51 a.m. on December 7, 2022 with a healthy weight of 6 pounds 9 ounces, a full head of hair, and a big smile.” She “She was an incredibly energetic and happy baby who loved her parents.
