BRISBANE, AUSTRALIA – Nicholas John Crilley sentenced to seven life sentences for raping and torturing a woman over 23 days in Brisbane, is appealing his sentence and conviction. Her victim, an unidentified woman, was injured so badly that emergency services thought she was dead.

Crilley is now appealing his sentence and sentence three years after he received seven life sentences for his drug-induced violence. The convict appeared before the Brisbane Court of Appeal via video link on Thursday March 2 and represented himself for his conviction appeal. Meanwhile, attorney Chelsea Waters appeared in court on Crilley’s behalf in his appeal of his sentence.

Crilley pleaded guilty to 62 counts in 2020, including grievous bodily harm, imprisonment, torture and 18 counts of rape in connection with what prosecutors described as a “sadistic” attack. The convict’s “callous and cruel” treatment of the 22-year-old woman in Brisbane in June 2017 left her permanently disfigured.

Appeals Court President Judge Debra Mullins said Crilley faced a “difficult hurdle” in his sentencing appeal. She told him Thursday that she would have to establish that there was a serious miscarriage of justice when the court accepted her guilty plea. “That’s a pretty tough hurdle to get over. It’s not impossible,” Mullins said. “I’m sure there’s talk in prison that every once in a while someone succeeds in an appeal against a conviction where there was a guilty plea. But, frankly, there have to be exceptional circumstances.”

Crilley said he reapplied for Legal Aid funding for the conviction appeal after failing the merits test. “While preparing my case, I came across quite a bit of material that makes my argument much stronger,” the convict said, adding: “I think I have strong reasons to get funding for it.” He insisted that he would represent himself in case his offer of legal help failed.

Judge Mullins, however, told Waters that the pursuit of a sentencing leave application would have to be put on hold until Crilley’s Legal Aid funding issue was resolved. A review is expected to take place in three months. “He really has to put on his skids and do something to push his application to Legal Aid for funding,” Mullins told Crilley. “It’s really to investigate whether he has grounds for any part of his guilty pleas,” she added.

It’s worth noting that Crilley’s victim suffered multiple broken bones, internal injuries, deep lacerations and burns to 46 percent of his body during the 2017 assault. The suspect was taken into custody after a dramatic police chase involving several stolen cars. .
