A 20-year-old Georgia mother accuses a doctor of decapitating her baby at delivery and then resting his head against her body to hide what they had done, a lawsuit claims. Jessica Ross, 20, and Treveon Isaiah Taylor Sr., are suing Dr. Tracey St. Julian and Southern Regional Medical Center, a hospital in Riverdale, Ga., where Ross went July 9 to have her son. According to the lawsuit, the baby’s shoulders got stuck during a vaginal delivery that began at 8:40 p.m. m. of that night. Dr. St. Julian is accused of delaying a C-section procedure and failing to seek help quickly. Instead, he applied “ridiculously excessive force” to the baby’s head and neck to try to get him out while Ross was still awake, says attorney and physician Roderick Edmond.

The baby’s body and legs were delivered by caesarean section three and a half hours later at 12:11 a.m., and her head was delivered vaginally. When Ross and Taylor demanded to see and hold their son, they claimed the baby was tightly wrapped in a blanket with its head “resting on his body” to make it appear as though it was still attached. They finally found out about the beheading from the undertaker, they claim.

Jessica Ross filed lawsuit against Dr. St. Julian

The lawsuit claims that Dr. St. Julian did not tell Ross and her family about her beheading when she spoke to them at approximately 5 a.m. m. of July 10. The grieving couple accused the hospital of trying to cover up what happened by discouraging them from having an autopsy and encouraging them to cremate their son.

“They were so excited about the birth of their first child,” said attorney Cory Lynch. “Unfortunately, her hopes and dreams turned into a nightmare that was covered up by Southern Regional Medical Center.” The lawsuit asks that Ross and Taylor be compensated for the suffering and death of their baby and the “tremendous mental and physical anguish and trauma” experienced by Ross.

Edmond claims that when Ross was admitted for a C-section, a fetal monitor had stopped recording his heartbeat. The couple had even asked for a C-section before, when the baby might still have survived, but were denied, Edmond said. Along with Dr. St. Julian and Premier Womens’ OB/GYN, LLC, a healthcare group of which St. Julian is a member, several hospital nurses are also charged with gross negligence in the couple’s lawsuit, as they the couple claim they failed to follow proper procedures once they learned the baby’s shoulders were stuck.

Calls to the St. Julian’s office were not returned and an email message was not immediately returned. Southern Regional said in a statement that it could not discuss the treatment of individual patients due to privacy laws, but denies the allegations against it.

Her “sincere thoughts and prayers” were with Ross and Taylor and their care providers, she said. “Our commitment is to provide quality, compassionate care to every patient, and this loss is heartbreaking,” the hospital said. She later added that St. Julian was not an employee of the hospital and that she had “taken appropriate measures in response to this unfortunate situation.” A spokeswoman, Kimberly Golden-Benner, said the hospital could not provide further details.

Premier Women’s OB/GYN has two locations and offers circumcisions, infertility treatment and other services in addition to low- and high-risk obstetric care, according to its website. St. Juilan is a board-certified OB/GYN who has been practicing in the Atlanta area since January 2005, the website says.

She said the case highlighted the higher infant and maternal mortality rates for black women. Ross and Taylor, 21, did not speak at Wednesday’s news conference.
