A 28-year-old father in Indiana has been arrested for allegedly killing his 1-year-old daughter inside his family’s home after an exam revealed she died with torn ligaments in her neck and a swollen brain from lack of oxygen. Milton called 911 the morning of July 31 and had his daughter taken to Riley Hospital for Children at Indiana University Health because she was having trouble breathing, according to a report in the Indianapolis Star. However, doctors quickly acknowledged that the injuries to the small child, who appeared to be of a suspicious nature, were life threatening and contacted the Indianapolis Police Department.

The victim was admitted to the facility’s intensive care unit for treatment. Doctors said the girl had suffered severe swelling in her brain that was likely caused by a lack of oxygen, as well as injuries to her neck ligaments. She also had multiple visible scratches on her face. “Findings based on statements, medical injuries and history were found to be highly suspicious for non-accidental/inflicted trauma,” police wrote in the affidavit, according to the Indy Star.

Detectives arrived at the scene and questioned Milton about her daughter’s injuries. During the interview, Milton reportedly told detectives that the girl had been “restless” all morning after waking up, and then suddenly she began to have difficulty breathing and became unresponsive. She also noted that she had been taken to the same hospital about two weeks earlier because she had fallen and hit her head on the carpet. She had no notable injuries, but Milton initially tried to explain that her daughter’s injuries were caused by that fall, according to the report. Amaya’s mother was reportedly at work the day her daughter sustained her fatal injuries.

Unfortunately, Ella Amaya remained in the ICU for six days before succumbing to her injuries and she was pronounced dead on August 6. The hospital’s Child Protection Team reportedly determined that her injuries may have been caused by being violently shaken. In a second interview with investigators, Milton reportedly admitted that he could sometimes be “mildly aggressive” with Amaya and explained that the scratches on her face were the result of him wiping away her tears too harshly.

Eventually, Milton allegedly admitted that the day before she was hospitalized, he had grown frustrated with Amaya and “pulled” her arm, picked her up, and gave her a “bear hug” with his nose and mouth pressed against her chest. while placing one of his hands on the back of her neck and squeezing as she gasped for air, Indianapolis Fox affiliate WXIN reported, citing the affidavit.

Doctors reportedly told police that Amaya’s injuries, particularly the lack of oxygen to her brain, could have been caused by the bear hug. Authorities have not yet released the final cause of the boy’s death.
