A 26-year-old Florida man was arrested this week for allegedly raping a 15-year-old girl he met while playing the online video game Fortnite. Dillon Atkinson was arrested last Thursday and charged with one count of lewd or lewd behavior and one count of assault on a victim between the ages of 12 and 16, court documents reviewed by Law & Crime show.

When he was caught, authorities say, Atkinson blamed a misunderstanding of age of consent laws. According to a probable cause affidavit, the victim’s parents called police after searching the school computer and discovering chats between her and a person using the email address “[email protected],” who later it was confirmed to be Atkinson.

When questioned about the chat logs, the victim admitted to her parents that she had “had a sexual relationship with a 26-year-old man” whom she met through Fortnite in June 2022. She said that in the previous two weeks, she and the 26-year-old man “had sexual intercourse multiple times, with the most recent incident occurring approximately two days ago,” the document says.

Dillon Atkinson Accused of raping a 15-year-old girl

Due to the nature of the allegations, the Lee County Sheriff’s Office Special Victims Unit went to the victim’s home and took over the investigation. The victim was transported to the Children’s Advocacy Center, where a case manager conducted a forensic interview in an attempt to learn additional details about the victim’s alleged relationship with Atkinson.

The victim confirmed that she and Atkinson knew each other’s ages when they first had sex in Atkinson’s work van approximately two weeks earlier, according to the affidavit. During that encounter, the victim allegedly said that Atkinson “entered her vagina, her anus, and her mouth with his penis.” She then dropped her off outside a convenient store.

The second alleged statutory rape took place about a week later at Atkinson’s home in Fort Meyers and involved similar sexual acts during which Atkinson’s condom broke.

“Afterward, [Atkinson] took the victim to a nearby Walgreens where she purchased Plan B and gave it to the victim as a precaution because the condom broke,” the affidavit reads. A third encounter between the two allegedly occurred next door to the victim’s home three days before she was to be interviewed by the case manager.

Detectives then went to Atkinson’s home, where he was detained and taken to LCSO headquarters for questioning. Atkinson allegedly agreed to speak to detectives without an attorney present after he was read her Miranda rights and confessed to having sex with the 15-year-old victim on multiple occasions.

“During his subsequent statement to Miranda, [Atkinson] confirmed that he and the victim had met approximately five months earlier in the Fortnite video game. The two began a friendship that later turned romantic in nature.

They began communicating through Discord, a phone app where people text, chat, and video call,” the affidavit reads. “[Atkinson] admitted to knowing that the victim was a minor because she told him that she was sixteen years old. However, he told the victim that her age did not matter to him.
