A Florida mall owner shot and killed another man for urinating in his building, Monroe County prosecutors say. Recently released surveillance footage and 911 audio appear to reinforce those claims. Lloyd Preston Brewer III, 57, is charged with one count of second-degree murder in the fatal shooting of Garrett Hughes, 21, an unarmed man who died in an alley behind Conch Town Liquor & Lounge on Roosevelt Boulevard in Key West on February 13. “I need someone in Conch Town right away,” a woman says on a 911 call. “Someone just got shot.”

According to police, Brewer is the man in the video confronting the shirtless victim after urinating on the side of the building. The assailant in the images then reaches around his waist before raising his arms. An altercation then occurs, though the shooting itself is unclear from the grainy footage. Moments later, Hughes would be dead.

Police would describe the defendant as getting into a “firing position” before the fatal shot took the young man’s life, according to a police report obtained by Miami-based ABC affiliate WPLG. “(Hughes) is stumbling around, and (Brewer) pulls up his shirt, pulls out a gun and shoots him in the stomach,” Monroe County State’s Attorney Dennis Ward previously told the television station.

Lloyd Preston Brewer accused of killing a man

Brewer claimed the shooting was in his own defense during his own 911 call. “Yes, hello, I just shot someone,” the defendant says on the recording. The dispatcher then asks who the man shot. “I don’t know,” Brewer says before asking someone nearby for the dying man’s name. Garrett Hughes.

The dispatcher then asks why the defendant shot the victim. “He aggressively approached me in my parking lot in Conch Town,” Brewer responds. Monroe, however, said that police and investigators concluded that “the video does not support that theory.”

“Brewer said it looked like Hughes was going to pull something out of his waist,” a Key West police detective wrote in a report obtained by WPLG. “Brewer was unable to identify exactly what was aggressive or threatening in Hughes’ behavior and he denied seeing Hughes in possession of weapons.” Brewer’s defense attorney, Chris Mancini, denied law enforcement’s interpretation of the video in a statement to the television station.

“The Monroe County (State Attorney’s Office) has asserted in the media that the videotape evidence, in this case, shows things that it absolutely does not,” Mancini said. “The SAO has been trying to convince the public that ‘this was a senseless murder’ and that Mr. Brewer was ‘upset’ and had a ‘distorted interpretation of the situation’ and that the video evidence does not ‘prove an Defend your position’. defense in this case.’”

In late March, Hughes’s parents, John Hughes and Lesley Touzalin, sued Brewer and various entities related to the killer and his family in a wrongful-death lawsuit filed in Monroe County. The family’s lawsuit does not name the bar, but alleges that entities related to Brewer were negligent on the day in question.

“By providing excessive amounts of alcohol to a known and habitual drunkard (Brewer), the (defendants) became liable for injuries and damages caused and resulting from (Brewer’s) intoxication,” the lawsuit reads. The discovery in the case was unsealed Thursday, the same day Brewer made his last court appearance. The defendant is currently being held at the Monroe County Jail without bond.
