Alishah Pointer was 22 when she was kidnapped, tortured and fatally shot in a prolonged, “horrifying” act of violence in Ohio in 2021. A Cleveland court on Monday declared a mistrial for three of the six people accused of brutally killing with his life. Anthony Bryant, 19, Brittany Smith, 33, and Hakeem-Ali Shomo, 31, have been on trial since March 6 on charges including aggravated murder, kidnapping, conspiracy and criminal assault.

His trial came to an end early Monday morning, the Cuyahoga County Court of Common Pleas said in a message to Law&Crime. “Before trial resumed this morning, there was a motion for mistrial,” the court statement said. “The court staff had sent a procedural communication to the parties, which was inadvertently sent only to the prosecutors. Because this could be considered an ex parte communication, out of an abundance of caution, the Court granted a mistrial and the judge excused himself from the case.”

In a statement to Shaker Heights-based CBS affiliate WOIO, the Cuyahoga County Prosecutor’s Office attributed the mistrial to a “miscommunication.” Shaker Heights is an affluent suburb located approximately 20 minutes east-southeast of Cleveland. Judge John Russo had been overseeing the jury trial.

Prosecutors believe the trial process will begin again in the next few days, according to Cleveland-based Fox affiliate WJW. The case has reportedly been reassigned to Judge Janet Burnside. Law&Crime contacted the court and the prosecutor’s office for additional details, but there were no immediate responses. Three other people charged in connection with Pointer’s death have pleaded guilty to lesser charges in exchange for her testimony.

Nathaniel Poke Jr., 23, Portria Williams, 31, and Destiny Henderson, 18, will testify against their co-defendants when the trial resumes. Poke and Henderson pleaded guilty to manslaughter, kidnapping and conspiracy charges. Williams pleaded guilty to charges of aggravated manslaughter, kidnapping and conspiracy.

Currently, the three witnesses are scheduled to be sentenced on March 27. That date could be pushed back due to Monday’s mistrial. The six people believed to share guilt in Pointer’s death allegedly drifted in and out of the broader crime at different times over the course of the day on November 4, 2021.

Prosecutors allege that Henderson, Williams, Poke Jr., and Hakeem Ali Shomo kidnapped two women as part of a retaliation plot because they believed Pointer’s boyfriend had killed Aminjas Shomo on November 2, 2021. The two abducted women were supposedly forced to help the couple. four locate Pointer and lure her into her car. The first two kidnapping victims were allowed to leave, police said.

Once Pointer was held captive, Poke left the residence, prosecutors allege. Smith and Bryant arrived at the scene later and were not involved in the initial abductions, authorities say. Shomo, Smith, and Bryant allegedly beat and tortured Pointer in an effort to extract information about Aminjas Shomo’s death.

After that, the police believe that the defendant Shomo left the residence at his own expense. Henderson, Smith, Williams and Bryant then allegedly forced Pointer into a vehicle and drove her to her Savannah Avenue home, since burned and demolished, where she spent her last terrified moments. Williams and Bryant are alleged to have fired the shots.

“There were plenty of opportunities for these people to reconsider what they were doing and for someone to make the right decision and stop this,” Cuyahoga County Attorney Michael O’Malley said when the indictments were filed. “This went on for hours, and this poor girl was tortured and mistreated.
