A Colorado plastic surgeon has been found guilty of attempted manslaughter charges in the death of a teenage patient who died 14 months after he botched her breast augmentation surgery. Dr. Geoffrey Kim 52, has admitted that he did not call 911 for five hours after 18-year-old Emmalyn Nguyen went into cardiac arrest when nurse Rex Meeker administered anesthesia on August 1, 2019.

A jury found him guilty of attempted reckless homicide and guilty of jamming a phone after he failed to call for help, but not guilty of the more serious charge, attempted reckless homicide. Kim, who was visibly dejected upon hearing the verdict, will be sentenced on September 8. He faces anything from probation to three years in prison. The charge he was acquitted of was considered the most serious crime, with Kim facing between one and three years in prison if he had been convicted.

Kim’s defense team blamed anesthetist Rex Meeker for Nguyen’s death, claiming he gave her a toxic mix of drugs before surgery, including enough fentanyl to stop her heart, according to the Denver Post. Meeker initially faced manslaughter charges, but dropped them in exchange for testimony at trial, according to 9news.

Dr. Geoffrey Kim accused of attempted manslaughter

Last week, he argued that Kim would not let him call 911 for more than five hours, KDVR reported. Both Kim and Meeker have already been forced to pay the Nguyen family $1 million each in a wrongful-death settlement. Meeker gave up his license to administer anesthesia but still has his medical license.

Nguyen was left brainless and unable to speak or walk after the surgery and died 14 months later. Her parents, Lynn Fam and Sonny Nguyen, told KDVR in December 2019 that her daughter wanted breast implants to bolster her self-image after graduating high school.

The teen, who was 18 at the time, had saved $6,000 for the surgery and was said to be in good health. The family’s lawyer, David Woodruff, said Emmalyn “was not observed.” No one observed her for about 15 minutes. A nurse walks into her room and finds her blue.

During the more than five hours Emmalyn lay on the operating table, Woodruff said mom Lynn sat in the waiting room unaware of her daughter’s condition. Lynn told the news station that at one point, the doctor came out of her to tell her that she would not be able to see her daughter. ‘She’s fine and she’s young, maybe that’s why she’s taking longer to wake up,’ Lynn said the doctor told her.

Woodruff said that when doctors arrived, they used CPR to try to revive Emmalyn, but she did not regain consciousness. Her brain injury meant she couldn’t talk, walk or feed herself, so she was admitted to a nursing home for 24-hour care. She had to be fed through a tube and put on an oxygen machine.

Arapahoe County Sheriff’s Office Captain Investigations Travis Stewart told the New York Post: “The investigation has taken more than two years to complete and involved dozens of interviews and search warrants.” “Our hope is that this is the beginning of bringing justice and a sense of closure to Emmalyn’s family.” Before her death, Woodruff said Emmalyn was showing signs of progress, she could smile at times and was medically stable, CBS Denver reported.

The family said Meeker failed to properly administer Emmalyn’s anesthesia and then failed to follow up on her condition. Meanwhile, Kim was said to have made a resuscitation attempt. In the eventual 911 call, Meeker can be heard saying, “She’s not conscious.” We have evaluated it. We have estimated a Glasgow score of 6 or 7.’ Anywhere between three and eight on the Glasgow scale indicates that a patient is in a coma.

Colorado state records prior to the Emmalyn case showed that Kim had not taken any prior disciplinary action against him. Meeker was said to have been sued in 2009, after a woman suffered brain damage and died while she was undergoing breast implant surgery. Meeker was the nurse anesthetist on that case.
