There’s no arguing: Jared Stephens committed a crime and deserved some kind of punishment. We are not suggesting that child pornography is not an evil act. Possessing it is a crime for a good reason.But the fight now in Florida courts to reduce the 150-year prison term Stephens received is about more than just laws and sentences.

It is about how our court system treats defendants with serious mental illness. The question is whether the 32-year-old diagnosed with schizophrenia, who spoke in court about cutting off electricity in Russia with his mind, should spend the rest of his life in prison.

Stephens is a former Arizona State University wrestler who was left homeless after suffering from untreated schizophrenia for years. In 2016, he broke into Sweetwater Best Buy and stole a laptop and other merchandise. When confronted by employees, he pulled out his own laptop and said, “Look, I have child pornography!” He began by publicly displaying his computer screen, leaning between two sets of sliding doors and examining the illegal images as customers walked by.

Jared Stephens sentenced to 150 years

His de facto life sentence seems out of the norm. The Herald reported that between 2000 and 2017, people sent to prison for possession of child pornography in Miami-Dade County received an average sentence of three years; about a third of the defendants did not go to prison. This is based on data from the Florida Department of Corrections that Stephens’ defense presented in court.

Stephens could have gotten those three years, plus the required treatment, if he had accepted a plea deal from prosecutors on one count of possession of child pornography, a charge that seems a better fit for the crime, from what we know. Stephens was not charged with producing or distributing the pornographic material.

Instead, he opted to go to trial, a decision his attorneys say was the result of his mental illness. The State’s Attorney’s Office later raised the charges to 30 counts, based on a forensic analysis that found his computer contained a cache of illegal images.
