An Italian jeweler Mario Roggero will be tried for manslaughter after he fired a firearm at a gang of robbers, killing two after they ransacked his boutique and tied up his daughter.

The incident unfolded on April 28 in Grinzane Cavour after three men, armed with a knife and a pistol, raided the 67-year-old Roggero’s shop.

The three men threatened Roggero and his family while tying his daughter with her hands behind her. However, he later discovered that the robbers were using a fake weapon. As they tried to flee with the stolen goods, he chased after them with his gun.

Mario Roggero fired five shots at the gang. Gang members Andrea Spinelli from Bra and Giuseppe Mazzarino from Turin died of their injuries a few meters from the entrance to the store, according to the Daily Mail.

One of them was found dead in the middle of the street while the other was found in the side street corner. The third robber, who was also injured, was later taken to hospital after attempting to flee the scene.

However, Roggero has been accused of negligent excess of legitimate defense and will be tried for murder. The prosecution claimed that he pursued the three robbers when they had already fled the store with the looted merchandise.

Roggero is accused of shooting at point-blank range “with the intention of causing their death, voluntarily exceeding the limits of legitimate patrimonial defense,” the source reported.

“I’m sorry something like this happened, it’s very bad, but it’s either me or them,” the owner said shortly after the attempted robbery. “With my right hand I opened the case, with my left the drawer where I knew my gun was and simultaneously we found ourselves pointing at each other.
