More than a year after an Asian man died after being assaulted in New York City, Jarrod Powell has pleaded guilty to his death and will serve 22 years in prison, the Manhattan District Attorney’s Office announced Thursday. Powell, 51, pleaded guilty to one count of first-degree manslaughter as a hate crime as part of a plea deal, the district attorney’s office said.

In April 2021, Yao Pan Ma was picking up cans when he was approached from behind on an East Harlem street corner, hit on the back, and after he fell to the ground, kicked in the head multiple times, according to police. Ma, who was Chinese-American, had been unresponsive and unconscious since he was admitted to a hospital for treatment of his head injuries. This unprovoked attack took the life of Yao Pan Ma and took away a sense of safety for many in the AAPI community in New York,” District Attorney Alvin Bragg said after the guilty plea. “Jarrod Powell attacked Mr. Ma because of his race and now he is being held accountable. Reported hate crimes against Asians in 16 of the nation’s largest cities and counties increased 164% in 2021, according to a study from Cal State San Bernardino’s Center for the Study of Hate and Extremism.
At around 8:30 p.m., a man hit Ma from behind, causing him to fall to the ground, police previously said. Surveillance video released by the New York Police Department’s Hate Crimes Task Force showed the man stomping on Ma’s head while he was on the ground.

An MTA bus driver, who stopped at a traffic light and saw the attack unfold, flagged down a nearby ambulance and Ma was taken to Harlem Hospital, where he was treated for facial fractures and bleeding in the brain. Ma was in a coma for months before dying on December 31.

Powell was arrested days after the attack and faced multiple felony charges of attempted murder and hate crimes. He had pleaded not guilty at his appearance. In pleading guilty, he admitted that he had attacked Ma because he was Asian, according to Bragg’s office.

Ma’s loved ones welcomed the long-awaited sentence, said Karlin Chan, a spokesman for the family. “While this will not bring back Mr. Yao Pan Ma, it is an important sentence that we can accept,” Chan said, according to The Associated Press. The spokesman said the guilty plea would spare the family the pain of a trial, the AP reported.

Ma and his wife had immigrated to the United States in October 2018 from China, where Ma had worked as a dim sum chef, Chan said, according to the AP. Ma was working as a chef in the US and his wife was working as a home care aide when they both lost their jobs during the pandemic shutdowns in 2020, Chan said.
